Terms of Service & Agreement

This Terms of Service & Agreement (the "Agreement") is entered into by and between The Holistic Health & Nutrition Center ("Company") and the Client ("Client") who engages the Company for holistic health and nutrition coaching services. By using our services, the Client agrees to the following terms and conditions:

1. Scope of Services

1.1. The Company provides personalized holistic health and nutrition coaching, including but not limited to dietary advice, meal planning, fitness guidance, meditation techniques, and wellness strategies.

1.2. The Company does not diagnose, treat, or cure medical conditions and is not a substitute for professional medical advice. Clients are encouraged to consult with a licensed healthcare provider before making any significant changes to their diet, exercise, or health routine.

2. Client Responsibilities

2.1. The Client agrees to provide accurate and complete information about their health history, current medical conditions, dietary preferences, and fitness levels.

2.2. The Client acknowledges that the effectiveness of the services depends on their participation, adherence to recommendations, and communication with the Company.

3. Payment and Fees

3.1. Payment for services must be made in advance unless otherwise agreed upon in writing.

3.2. Accepted payment methods include Zelle, CashApp, Cash or Bitcoin.

3.3. Subscription fees for online coaching or premium services are recurring and will automatically renew unless canceled by the Client at least three business days before the renewal date.

4. Cancellation and Refund Policy

4.1. Cancellations must be made at least 24–48 hours before a scheduled session to avoid forfeiting the session fee.

4.2. Refunds are only issued for unused sessions or services canceled by the Company. Subscription fees are non-refundable.

4.3. The Company reserves the right to terminate services for non-compliance or abusive behavior without a refund.

5. Confidentiality and Privacy

5.1. The Company is committed to protecting the privacy of the Client's personal information and will not share it with third parties without the Client's consent, except as required by law.

5.2. The Client agrees to keep proprietary materials, resources, and tools provided by the Company confidential and not to share, reproduce, or distribute them without written permission.

6. Disclaimer

6.1. The Company's services are educational and motivational in nature, designed to support the Client's overall wellness.

6.2. Results may vary and are not guaranteed. The Client acknowledges that success depends on individual effort, circumstances, and consistency.

7. Liability Waiver

7.1. The Client assumes full responsibility for any decisions, actions, or outcomes resulting from the use of the Company's services.

7.2. The Company is not liable for any injuries, illnesses, or adverse reactions resulting from the Client's participation in coaching sessions, recommendations, or nutritional plans.

8. Dispute Resolution

8.1. Any disputes arising from this Agreement will be resolved through mediation before resorting to litigation.

8.2. The Agreement shall be governed by the laws of the State of California, without regard to conflict of law principles.

9. Amendments

9.1. The Company reserves the right to amend these terms and conditions at any time. Clients will be notified of significant changes in writing or via email.

9.2. Continued use of the Company's services after any amendments constitutes acceptance of the revised terms.
